Terms of Service
HostSEO ("The Company") agrees to furnish services to the Subscriber, subject to the following TOS (Terms of Service).
Use of HostSEO Service constitutes acceptance and agreement to HostSEO's TOS (Terms of Service), which has the legal binding value of a contract. Ordering and/or using our services constitutes an acceptance of the terms, provisions and conditions of this contract as stipulated in both the present TOS.
All provisions of this contract are subject to the present TOS (Terms of Service). This Agreement shall be construed in all respects in accordance with the laws of the state of New Jersey, county of Bergen applicable to contracts enforceable in that state. Venue will be Bergen County, New Jersey.
1. Disclosure to Law Enforcement: The TOS specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition HostSEO shall have the right to terminate all service set forth in this Agreement.
2. Unacceptable Use Of Resources:
* Posting a single article, or substantially similar article/data to an excessive number of news groups or forums or continual posting of off-topic discussions. Following a complaint by a newsgroup/forum/website due to inappropriate behavior by a customer and unethical methods of marketing an promotion of a website residing within the network of HostSEO, service to the customer may be temporarily suspended or permanently terminated.
* Sending unsolicited emails from HostSEO's network with or without intention of marketing/promotion. This is treated as spam and would result in suspension/termination of service to the customer.
* Engaging in either inappropriate postings, copyright infringement, spam using services from a provider other than HostSEO for the promotion or marketing of a website that lies within the HostSEO network is also considered unethical and hence treated as a violation of a TOS. This would result in suspension/termination of services to the customer.
* Continual harassment of individuals over the internet even upon being asked to stop by the victims and/or HostSEO.
* Engaging in mail bombing (sending large volumes of emails to a particular individual's e-mail address)
* Attempts to hack and gain access to another user's personal information without the consent of the user.
* Network Unfriendly Activity: Attempts to interfere with regular operations of HostSEO's systems that hampers the smooth running of HostSEO or its network connections or any action that adversely affects the ability of users to use HostSEO's services over the internet including but not limited to:
* Any unauthorized attempts to gain root access to any of HostSEO's servers or other client's accounts.
* Use of HostSEO's services, servers and systems to disrupt services of another provider.
* Usage of server resources, network and bandwidth resources in a manner than hampers the performance of other accounts on the same server, other servers using the same network or any other system used by HostSEO to provide its services.
3. Banned Content: HostSEO does not currently allow adult, gambling or pharama related sites on it's network (to protect the integrity of our ip's). Use of any such content will result in one warning followed by termination of services.
4. Payment: Establishment of this service is dependent upon receipt by the Company of payment of stated charges. Subsequent payments are due on the anniversary date of the month for that month's service.
5. Refund and Disputes: All payments to HostSEO are nonrefundable. This includes the one time setup fee and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 60 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in HostSEO's sole discretion is a valid charge under the provisions of the TOS and /or TOS, you agree to pay HostSEO an "Administrative Fee" of not less than $50 and not more than $350.
6. Failure to Pay: The Company may temporarily deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.
7. Liability: Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
